TERMS OF USE

These Terms of Service (“Terms”) govern your access to and use of the TopStack HR website located at topstackhr.com (the “Site”) and the outplacement services offered through the Site (the “Services”). By accessing the Site or purchasing Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site or Services.

2. Description of Services

TopStack HR provides employer-sponsored outplacement services, including but not limited to resume writing, career coaching, and hands-on job search support, depending on the program selected.

Services are purchased by employers and made available to participants through the use of activation codes. Specific features, timelines, and levels of support vary by program.

3. Eligibility

The Services are intended for use by adults engaged in career transition.
We do not knowingly provide Services to minors under the age of 18.

The Site and Services are offered primarily to users in the United States, but may be accessed internationally.

4. Purchases, Payment & Billing

We accept the following payment methods:

  • Credit card

  • ACH transfer

  • Wire transfer

  • Check

All purchases are subject to review and acceptance by TopStack HR. Prices, program details, and terms in effect at the time of purchase apply.

5. Activation Codes & Program Access

  • Each purchased program includes a unique activation code.

  • Activation codes may be distributed by the employer to participants at the employer’s discretion.

  • Activation codes must be redeemed within six (6) months of issuance.

  • Once an activation code is redeemed, the associated services are considered in progress.

6. Refunds & Credits

Our refund and credit practices are governed by a separate Refund & Credit Policy, which is incorporated into these Terms by reference.

Key principles:

  • Services are non-refundable once an activation code has been redeemed.

  • Unused activation codes that expire may be eligible for a credit, not a refund.

  • Credits are valid for two (2) years from the date the credit is issued (which occurs after activation code expiration), not from the original purchase date.

  • Refunds, if any, are handled on a case-by-case basis at our discretion.

7. Participant Data & Employer Access

Participant data is collected for the sole purpose of delivering Services.

  • Employers do not have access to individual participant files, resumes, communications, or job search materials.

  • Employers may receive aggregated or high-level reporting related to program utilization and outcomes.

  • We do not share participant personal data with employers beyond what is necessary to administer the program.

8. Intellectual Property

All content on the Site, including text, graphics, branding, and program materials, is owned by or licensed to SJM Ventures LLC and may not be copied, reproduced, or distributed without written permission.

Participants retain ownership of their personal career documents but grant us a limited license to use them solely for providing Services.

9. No Guarantee of Employment

While our Services are designed to support successful career transitions, we do not guarantee employment outcomes, job offers, compensation levels, or timelines.

Results depend on many factors outside our control, including labor market conditions and participant engagement.

 

10. Limitation of Liability

To the maximum extent permitted by law:

  • SJM Ventures LLC shall not be liable for indirect, incidental, consequential, or special damages.

  • Our total liability arising from or related to the Services shall not exceed the amount paid for the specific Services giving rise to the claim.

 

11. Indemnification

You agree to indemnify and hold harmless SJM Ventures LLC from any claims, damages, or expenses arising out of misuse of the Site or Services, violation of these Terms, or violation of applicable laws.

 

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in North Carolina.

 

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site or Services constitutes acceptance of the revised Terms.
